The Traffic Stop
Most drunk driving arrests begin with a traffic stop. What to do at a traffic stop is often the subject of conflicting conversation. People wonder whether they should roll the window down a few inches or all the way, and whether they should put something in their mouths to mask the smell of alcohol.
While there are many different pieces of advice drivers may hear, one solid one is that drivers should have their license, registration, proof of insurance handy. Taking too long to search for these documents may cause officers to become concerned that you were drinking.
If the officer thinks you have been drinking, he or she may ask you to complete a series of field sobriety tests. If you do not pass these tests, the officer may tell you that you are under arrest and may also bring you to the police station for blood, breath or urine tests of your blood alcohol content.
The Arraignment
Your first court appearance is called an arraignment. In this initial appearance, you will probably appear before the judge and enter a plea. You may choose to plead no contest, not guilty or guilty. We will educate you about the possible consequences of each plea, however. We want you to make an informed decision about how to proceed. If you choose to plead "not guilty," we are here to mount an aggressive defense.
