Protecting Your Commercial Driver's License (CDL)
License suspension is one of the most common consequences of a DUI arrest. The consequences are even more severe when your commercial driver's license (CDL) is on the line. You could lose your financial stability and even your career.
At the Cincinnati, Ohio law office of attorney Matthew Ernst, we represent CDL drivers accused of driving under the influence of alcohol. We are dedicated to helping you build a strong and effective criminal defense that helps you avoid the consequences you face.
There are several ways that you can lose your license under Ohio law:
- Administrative license suspensions can happen when a breath test reveals a prohibited BAC (or blood alcohol concentration) of 0.08 or higher.
- Administrative license suspensions may also happen when you refuse to submit to a blood, breath or urine test when required to do so by law enforcement.
- You may also face a court suspension of your driver's license when convicted of operating a motor vehicle while intoxicated.
When Can I Drive?
Many people who have been accused of drinking and driving wonder what will happen to their driver's licenses. Working with a lawyer can help you get your driver's license back as quickly as possible. Your lawyer may be able to appeal a suspension at an initial court appearance which will be held within five days of the arrest. With your lawyer's help, you may also be able to petition the court for limited driving privileges. Your lawyer may also be able to help you get your license reinstated after the suspension period is over.
If—at the time of your arrest—you test over the 0.080 limit, your CDL may be suspended by the Bureau of Motor Vehicles. While you face this suspension, you cannot get court permission to operate a commercial vehicle. However, you can appeal this suspension within 30 days.
