If you have a prior OVI and you get charged within six years of the conviction date of the prior OVI, the penalties include up to 20 days in jail or a program mandatory. Each time you have a subsequent conviction, the ramifications and the mandatory penalties increase substantially. If you receive and are convicted of four DUIs in a six-year period, it's a felony, which includes mandatory time but can include prison time up to 30 months.

Currently, there's different levels of OVI throughout the state, meaning the legal limit in the state of Ohio is 0.08. And the what we call super DUI or high-tier DUI begins at a 0.170. If you test over a 0.170, even on your first OVI in your life, you're required to have the restrictive plates or what some call the party plates. They have the yellow restricted license plates that label you as an OVI offender.

When someone is charged with an OVI in the state of Ohio, they must be brought to court within five business days. I want someone to be in court as quickly as possible so we can address driving privileges or we can address having the administrative suspension lifted or stayed. Every case is prepared for trial. And if anywhere along the way a positive resolution can be negotiated, we can end the case earlier.
