My name is attorney Matthew Ernst. And I represent citizens charged with operating a vehicle under the influence. What used to be called DUI is now called OVI. My office is located in downtown Cincinnati. And I mainly practice in the Hamilton, Butler, Warren, and Claremont counties.
I chose to represent citizens charged with DUI because it's a common offense that you can find yourself caught up in. It's the average person that gets caught. When you get behind the wheel, you don't always know what your blood or breath alcohol level will be.
Knowing the law isn't all you need to know to practice successfully in OVI. Knowing who the prosecutor is, knowing who the judge is, knowing how to negotiate with a certain prosecutor, knowing their strengths and weaknesses, knowledge of the equipment used to convict citizens is also of vital importance.
The machine behind me is an Intoxalyzer 5000. It's one of two breath machines currently used in the state of Ohio to measure breath. That breath machine is estimating how much alcohol is in your blood. It's not an exact science. The machine is not always right. And having the knowledge of what makes the machine work or not work is vital in representation for DUI.
When I meet with a new client, their biggest worries seem to involve the mandatory incarceration involved with every DUI and with a driver's license suspension. To alleviate the clients' initial apprehensions about the case when they come in to see me, to put some of those fears at ease, I let them know what they're facing, what I believe I can accomplish for this case, and that they know they're hiring someone who is hardworking, knowledgeable, and prepared.
